Frequently Asked Questions

How long does a landlord have to return a security deposit?
It varies by state, from 14 days (Arizona, Hawaii, Nebraska, South Dakota, Vermont) to 60 days (Alabama, Arkansas, West Virginia). Most states fall in the 21–30 day range. Use the calculator above to find your state's exact deadline.
What happens if a landlord doesn't return a security deposit on time?
Penalties vary by state but commonly include forfeiting the right to make deductions, owing double or triple the withheld amount, and paying the tenant's attorney fees. California allows up to 2x damages for bad-faith retention; Texas allows 3x plus $100.
Is a landlord required to pay interest on a security deposit?
Only some states require interest. Connecticut, Maryland, Massachusetts, Minnesota, New Jersey, New York (buildings with 6+ units), and Virginia are among those that do. Most states do not require interest for small landlords.
What can a landlord deduct from a security deposit?
Generally, landlords can deduct for unpaid rent, damages beyond normal wear and tear, and cleaning costs to restore the unit to its original condition. Normal wear and tear (faded paint, worn carpet, minor scuffs) cannot be deducted in any state.
Do landlords have to provide an itemized list of deductions?
Yes, virtually every state requires an itemized statement of deductions. Many states require receipts or estimates for the deducted amounts to be included with the statement.
