Should both the landlord and tenant sign the checklist?

Yes. Both signatures confirm that both parties agree on the documented condition. An unsigned checklist carries less weight in a dispute. Have both parties sign at move-in and again at move-out.

Should I take photos during the inspection?

Absolutely. Photos with timestamps supplement the written checklist and provide visual evidence. California (AB 2801, effective 2025) now requires landlords to take move-out and post-repair photos. Take photos of every room and any pre-existing damage.

What is considered normal wear and tear?

Normal wear and tear includes minor scuffs on walls, faded paint, worn carpet in traffic areas, small nail holes, and minor door/window wear from regular use. Damage beyond normal wear includes large holes in walls, stains, broken fixtures, and pet damage.

Is a move-in inspection required by law?

Requirements vary. Some states strongly encourage or effectively require it (by limiting deposit deductions without one). Regardless of legal requirements, conducting and documenting an inspection is strongly recommended as standard landlord practice.
